These Terms & Conditions (“Terms”) apply to your use of this website and, where applicable, your purchase of the Foundation Courses and your participation in the Istanbul Property Advisory Programme provided by Kemal Şen.
1. Provider
The website, Foundation Courses, and Advisory Programme are provided by:

2. Foundation Courses
The Foundation Courses are digital educational products providing general information and educational guidance about the Istanbul property market and the property purchase process in Türkiye.
The courses are provided for the purchaser’s personal educational use. They do not constitute legal, tax, financial, investment, immigration, citizenship, or other professional advice.
Property markets, prices, laws, regulations, and procedures may change over time. Information contained in the courses may therefore become outdated. You remain responsible for independently verifying information and obtaining independent specialist advice where appropriate before making decisions based on the course content.
The courses do not guarantee any particular property purchase, investment return, rental income, capital appreciation, citizenship outcome, or other result.
The Foundation Courses are purchased separately and do not, by themselves, constitute a purchase of the Istanbul Property Advisory Programme. Purchasing the Foundation Courses does not create an obligation for the client to proceed with the Istanbul Property Advisory Programme.
3. Foundation Course Access and Use
Following successful payment, you will receive access to the purchased Foundation Courses according to the arrangements stated at the time of purchase.
Course access and materials are personal to the purchaser. You may not share your login details or course materials with others, reproduce or redistribute the materials, resell them, upload them to another platform, or otherwise make them available to third parties without prior written permission.
Any unauthorised use, distribution, reproduction, or resale of the Foundation Courses may result in the immediate suspension or termination of access, without prejudice to any other rights or remedies available to me. I reserve the right to pursue all available legal remedies in response to such unauthorised use.
4. Istanbul Property Advisory Programme
The Istanbul Property Advisory Programme is a professional property advisory service provided by Kemal Şen in Türkiye. The Programme provides personalised guidance relating to property selection and purchase in Istanbul.
The specific scope, duration, deliverables, and fees of the Programme are those described on the website and/or communicated to you before purchase.
The Advisory Programme does not constitute legal, tax, financial, investment, immigration, citizenship, or other regulated or specialised professional advice. Where such advice is required, you should consult an appropriately qualified specialist.
Property purchases and investments involve risks. No particular property purchase, investment return, rental income, capital appreciation, citizenship approval, or other outcome is guaranteed.
The final decision whether to purchase a property, make an investment, or take any other action remains solely with you.
5. Independent Professional Advice and Third-Party Services
You remain responsible for obtaining independent professional advice where appropriate.
Property transactions and citizenship applications may involve third parties, including property owners, agents, developers, lawyers, notaries, banks, government authorities, translators, and valuation companies. These third parties act independently, and any services they provide are subject to a separate agreement between you and the third party.
In particular, any legal services relating to Turkish Citizenship by Investment are provided directly by an independent lawyer and are not provided by Kemal Şen.
Any referral, introduction, or recommendation of a third-party professional does not make Kemal Şen responsible for that professional’s advice, services, conduct, fees, or contractual obligations.
Unless expressly stated otherwise, third-party professional fees are not included in the fees payable to Kemal Şen.
6. Fees and Payment
The Foundation Courses may be purchased individually or as a bundle at the applicable price displayed at the time of purchase.
If the brokerage represents you as your buyer’s agent in connection with a property purchase, a buyer’s commission of 2.4% (2% plus Value Added Tax) of the property purchase price applies. The commission is only payable if you successfully purchase a property in a transaction in which the brokerage represents you. The commission is payable in accordance with the applicable real estate brokerage agreement and other relevant transaction agreements in Türkiye.
Payments must be made using the payment method and schedule specified at the time of purchase.
Payment-card information is processed by the relevant payment provider.
7. 14-Day Money-Back Guarantee – Foundation Courses
In addition to any mandatory statutory rights, the Foundation Courses come with a 14-day money-back guarantee. If the Foundation Courses do not meet your expectations, you may request a full refund within 14 days of purchase by contacting:

The refund will normally be made using the original payment method.
This guarantee does not limit or replace any mandatory statutory cancellation, withdrawal, refund, or other consumer rights that may apply.
8. Customer Responsibilities
You agree to:
- provide accurate and complete information relevant to the services
- communicate material changes to your objectives or circumstances
- conduct appropriate due diligence
- obtain independent specialist advice where appropriate
- make your own final decisions concerning property purchases, investments, and other transactions.
I am not responsible for consequences resulting from inaccurate, incomplete, or misleading information provided by you.
9. Intellectual Property
All Foundation Course materials, including videos, documents, presentations, graphics, and other educational content, are owned by or licensed to Kemal Şen and are protected by applicable intellectual-property laws.
Purchasing a course gives you a personal, non-exclusive right to access and use the materials for your own educational purposes. It does not transfer ownership of the underlying intellectual property.
Unauthorised copying, sharing, redistribution, publication, reproduction, uploading, or resale is prohibited, except where permitted by applicable law.
Any unauthorised distribution, reproduction, or resale of the Foundation Courses may result in the immediate suspension or termination of access, without prejudice to any other rights or remedies available to me. I reserve the right to pursue all available legal remedies in response to such unauthorised use.
10. Limitation of Liability
To the extent permitted by applicable law, I cannot be held responsible for losses resulting from decisions that you make based on information or guidance provided through the website, Foundation Courses, or Advisory Programme. This includes losses relating to property purchases, investments, changes in property values, rental income, financing, taxation, legal or regulatory changes, or citizenship applications.
Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.
11. Statutory Consumer Rights
Nothing in these Terms is intended to exclude or restrict any mandatory consumer rights that apply to you under applicable law. Where mandatory law provides rights that differ from or are more favourable than these Terms, those rights will apply.
Digital products and services may be subject to specific statutory rules concerning withdrawal and cancellation. Where applicable, these rules take precedence over the contractual provisions above.
12. Privacy
Personal data is processed in accordance with the Privacy Policy published on this website.
13. Governing Law
These Terms are governed by the laws of the Republic of Türkiye, subject to any mandatory consumer-protection provisions that apply to you and cannot lawfully be excluded.
Nothing in this section is intended to deprive consumers of mandatory rights available under applicable law.
14. Disputes
Any dispute arising from these Terms or the products and services will, subject to mandatory consumer-protection rules and applicable statutory dispute-resolution procedures, be subject to the jurisdiction of the courts and authorities in Türkiye.
Where mandatory law gives you the right to bring proceedings in another jurisdiction or before another competent authority, that right remains unaffected.
15. Changes to These Terms
These Terms may be updated from time to time to reflect changes to the website, products, services, or applicable legal requirements.
The Terms applicable to a purchase will generally be the version presented to you at the time of purchase, subject to mandatory legal requirements.
