These Terms & Conditions (“Terms”) apply to your use of this website and, where applicable, your purchase of the Foundation Courses or Istanbul Property Advisory Programme provided by Kemal Şen.
1. Provider

2. Foundation Courses
The Foundation Courses are digital educational products providing information and guidance about the Istanbul property market and the property purchase process in Türkiye.
The courses are provided for personal educational use. They do not constitute legal, tax, financial, investment, immigration, citizenship, or other professional advice.
The courses do not guarantee any particular property purchase, investment return, rental income, capital appreciation, citizenship outcome, or other result.
3. Foundation Course Access and Use
Following successful payment, you will receive access to the purchased Foundation Courses according to the arrangements stated at the time of purchase.
Course access and materials are personal to the purchaser. You may not share your login details or course materials with others, reproduce or redistribute the materials, resell them, upload them to another platform, or otherwise make them available to third parties without prior written permission.
Unauthorised use may result in suspension or termination of access, subject to applicable law.
4. Istanbul Property Advisory Programme
The Istanbul Property Advisory Programme is a personalised advisory service provided by Kemal Şen in Türkiye.
The Programme provides guidance relating to property selection and purchase in Istanbul and, where applicable, general guidance concerning Turkish citizenship by property.
The specific scope, duration, deliverables, and fees of the Programme are those described on the website and/or communicated to the client before purchase.
The Programme does not constitute legal, tax, financial, investment, immigration, or citizenship advice.
No particular property purchase, investment return, rental income, capital appreciation, citizenship approval, or other outcome is guaranteed.
The final decision whether to purchase a property or take any other action remains solely with the client.
5. Independent Professional Advice
Clients remain responsible for obtaining independent professional advice where appropriate.
Where a lawyer, tax adviser, valuation company, or other professional is involved, that professional acts independently and any services provided by them are subject to a separate agreement.
Unless expressly stated otherwise, third-party professional fees are not included in the fees payable to Kemal Şen.
6. Fees and Payment
The applicable price and payment terms will be displayed or communicated before purchase.
Payments must be made using the payment method and schedule specified at the time of purchase.
Payment-card information is processed by the relevant payment provider.
7. 14-Day Money-Back Guarantee – Foundation Courses
In addition to any mandatory statutory rights, the Foundation Courses come with a 14-day money-back guarantee.
If the Foundation Courses do not meet your expectations, you may request a refund within 14 days of purchase by contacting:

The amount paid will be refunded, less any transaction fees that are genuinely non-refundable and have actually been charged by the payment provider.
The refund will normally be made using the original payment method.
This guarantee does not limit any mandatory statutory consumer rights.
8. 14-Day Money-Back Guarantee – Istanbul Property Advisory Programme
The Foundation Courses provide substantial value independently and are intended to allow you to evaluate both the courses and my advisory approach before proceeding with the Advisory Programme.
If you purchase the Advisory Programme and decide within 14 days that it is not right for you, you may withdraw from the Programme and request a refund of payments made up to that point.

Payments made up to the point of withdrawal will be refunded, less any transaction fees that are genuinely non-refundable and have actually been charged by the payment provider.
This guarantee does not limit or replace any mandatory statutory cancellation, withdrawal, refund, or other consumer rights that may apply.
9. Customer Responsibilities
You agree to:
- provide accurate and complete information relevant to the services;
- communicate material changes to your objectives or circumstances;
- conduct appropriate due diligence;
- obtain professional advice where appropriate; and
- make your own final decisions concerning property purchases, investments, and other transactions.
I am not responsible for consequences resulting from inaccurate, incomplete, or misleading information provided by you.
10. Third-Party Services
Property transactions and citizenship applications may involve third parties, including property owners, agents, developers, lawyers, notaries, banks, government authorities, translators, and valuation companies.
I am not responsible for the acts, omissions, fees, representations, or contractual obligations of such third parties.
Any agreement between you and a third party is separate from your agreement with Kemal Şen.
11. Intellectual Property
All Foundation Course materials, including videos, documents, presentations, graphics, and other educational content, remain the intellectual property of Kemal Şen or the relevant rights holder.
Purchasing a course gives you a personal, non-exclusive right to access and use the materials for your own educational purposes. It does not transfer ownership of the underlying intellectual property.
Unauthorised copying, sharing, redistribution, publication, or resale is prohibited, except where permitted by applicable law.
12. Limitation of Liability
To the extent permitted by applicable law, I am not responsible for losses arising from decisions made by you based on information or guidance provided through the website, Foundation Courses, or Advisory Programme.
This includes losses relating to property purchases, investments, changes in property values, rental income, financing, taxation, legal or regulatory changes, or citizenship applications.
Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.
13. Statutory Consumer Rights
Nothing in these Terms is intended to exclude or restrict any mandatory consumer rights that apply to you under applicable law.
Where mandatory law provides rights that differ from or are more favourable than these Terms, those rights will apply.
Digital products and services may be subject to specific statutory rules concerning withdrawal and cancellation. Where applicable, these rules take precedence over the contractual provisions above.
14. Privacy
Personal data is processed in accordance with the Privacy Policy published on this website.
15. Governing Law
These Terms are governed by the laws of the Republic of Türkiye, subject to any mandatory consumer-protection provisions that apply to you and cannot lawfully be excluded.
Nothing in this section is intended to deprive consumers of mandatory rights available under applicable law.
16. Disputes
Any dispute arising from these Terms or the products and services will, subject to mandatory consumer-protection rules and applicable statutory dispute-resolution procedures, be handled by the competent courts and authorities in Türkiye.
Where mandatory law gives you the right to bring proceedings in another jurisdiction or before another competent authority, that right remains unaffected.
17. Changes to These Terms
These Terms may be updated from time to time to reflect changes to the website, products, services, or applicable legal requirements.
The Terms applicable to a purchase will generally be the version presented to you at the time of purchase, subject to mandatory legal requirements.
